Kalshi gold and silver perps are a 40.2 filing, not a CFTC vote

Headlines said Kalshi “added gold and silver futures after CFTC approval.” The filing path is narrower. On 9 September 2026 Kalshi self-certified GOLDPERP and SILVERPERP under CFTC Regulation 40.2(a). A designated contract market can attest that a product complies with the Commodity Exchange Act and list it without a Commission roll-call. That is not a yes vote. It is a notice.

What actually listed

GOLDPERP tracks the US-dollar spot price of one troy ounce of gold. SILVERPERP tracks the matching silver spot. Both are cash-settled. There is no physical delivery and no expiry date. A funding payment is meant to keep the contract near spot, the same structure Kalshi already uses on crypto perps. Pyth Network is the named price source. Hours in the filing are 24/7, including weekends and holidays — wider than the 24/5 window Kalshi had discussed in July.

These are not the short-dated gold and silver event contracts already on the exchange. A binary “will gold close above X” ticket and a perpetual future are different products. Do not flatten them into one “Kalshi metals” tile.

What “CFTC approval” is not

Regulation 40.2 is the self-certification lane. The exchange files; the Commission does not have to vote the product up. Bitcoin perps on Kalshi did take a slower approval path earlier in 2026. Gold and silver did not reuse that path. If a social post says “CFTC approved gold futures,” read 40.2 before you size.

CME Group sued the CFTC in June arguing that Kalshi’s Bitcoin perpetual should be classified as a swap, not a futures contract. The CFTC asked the court to dismiss. The court has not ruled. That docket is live. Listing two metal perps on the same structure does not settle it. Treat GOLDPERP and SILVERPERP as the same legal question wearing a different underlying.

What this does not change on our pages

USA cash event contracts are still Kalshi and ForecastEx for the questions those DCMs actually list. A gold perpetual is a derivatives product, not a reason to rerank the sports map or the election board. Sports access is still a circuit split. A metal perp does not reopen Nevada sports.

It also does not make Predict Fun a Kalshi alternative. BNB pool TVL is not a CFTC DCM. That note is unchanged on the watchlist briefing and on Kalshi alternatives.

How to read the ticket

If you open GOLDPERP, you are not taking delivery of metal. You are taking cash PnL against a Pyth print, with funding, 24/7 hours, and whatever margin and fee schedule Kalshi shows in the product you actually click. Mid is still not a fill — see fees and spreads. Access is still the login you have, not a screenshot — see access and KYC.

Silver supply-deficit copy in the filing is marketing context, not a resolution source. If a related event contract names a government print or a futures settle, read that source. Do not import a perp pitch into a binary ticket. That is the same rule as resolution disputes.
